SERVICECARE . CONDITIONS OF SALE 1. THE WHOLE CENTRAL HEATING SYSTEM The central heating boiler together with the pump, thermostatic radiator valves, motorised valves and cylinder thermostat, time, temperature and pressure controls, radiators, pipe- work (except under concrete floors), hot water cylinder (except mains pressure or heatstore units), heating expansion tank and any gas heater providing hot water 1.1 PRIORITY ATTENTION Emanuel Spence will endeavour to call the same day in response to any breakdown or failure of the central heating or other essential gas appliance. No calls will be made from 2100 hrs to 800 hrs. 1.2 SAFETY CHECK At the same time as the annual visit a ServiceCare Engineer will check the safe operation of the gas appliance(s) covered by this ServiceCare Contract 1.3 ANNUAL VISIT A Servicecare Engineer will inspect the central heating once a year and clean and adjust as necessary. The Servicecare contract also covers a visual inspection and you will be notified of any faults. 1.4 BREAKDOWN - NO CHARGE FOR LABOUR AND PARTS (Subject to cover limit) No charge will be made in respect of labour or parts and materials used in repairing any reported fault. 2. PERIOD OF ServiceCare CONTRACT This ServiceCare Contract is valid for the period on the front of this application form and for each period it is renewed thereafter. 3. PAYMENT AND RENEWAL 3.1 Payment for the ServiceCare Contract may be made annually in the manor specified in the front of this application form and this agreement will automatically terminate if the customer fails to make any payment due. 3.2 Where payment is made annually, the renewal date of the ServiceCare Contract will be the yearly anniversary of the date the ServiceCare Contract is first taken out 3.3 Emanuel Spence at its discretion may refuse to offer renewal of any ServiceCare Contract at the end of the period for which payment has been made or offer a reduced level of cover. 3.4 If payment is made by credit card we will renew cover automatically for you
4. CHANGE OF OWNERSHIP 4.1 If the owner of the premises in which central heating or the appliance(s) covered by this ServiceCare Contract changes, the new owner shall have the benefit of the ServiceCare Contract for the remainder of the period for which the atmual payment or installment thereof has been paid. 4.2 No refund will be made for the unexpired part of any ServiceCare Contract. 5. PROVISION OF SPARE PARTS 5.1 Emanuel Spence may supply and fit adequate replacement parts or components which are not the same as the parts being replaced 5.2 Emanuel Spence shall not be held responsible for any delay in the provision of spare parts by suppliers. 5.3 The cover is up to £450 inc VAT for total cost of callouts, labour and materials. 6. REPLACEMENT OF CENTRAL HEATING BOILERS OR OTHER GAS APPLIANCES THIS SERVlCECARE CONTRACT DOES NOT INCLUDE THE REPLACEMENT OF THE CENTRAL HEATING BOILER OR OTHER GAS APPLIANCE(S) IN THE EVENT OF SPARE PARTS OR COMPONENTS NOT BEING REASONABLY AVAILABLE. 7. CONDITIONS OF THE CENTRAL HEATING SYSTEM APPLIANCE(S) OR OTHER GAS APPLIANCES 7.1 Acceptance of the central heating system/ appliance(s) or any other gas appliance of system components on a ServiceCare Contract does not imply that it is installed satisfactory or to the prevailing standards of Emanuel Spence. Emanuel Spence will not accept responsibility for any inadequacy attributable to the original design and makes no warranty as to fitness for the purposes or condition 7.2 At the time of the first service visit Emanuel Spence reserves the right to cancel the ServiceCare Contract and refund any monies paid for reasons of safety, accessibility for servicing or non-availability of spare parts. 8. USE OF SUB-CONTRACTORS Emanuel Spence reserves the right to use sub-contractors to carry out all or part of the service to be provided under this ServiceCare Contract. 9. LIMITATION OF OBLIGATIONS Emanuel Spence shall not be liable if it is unable to carry out its obligations under the Service Care Contract due to industrial dispute of force majeure. 9.1 Emanuel Spence may terminate a service contracted and refund monies at any time. 10. EXCLUSIONS The following are excluded from this ServiceCare Contract 10.1 Adjustment to time and temperature controls. 10.2 The replacement of decorative parts. 10.3 Any domestic water supply from the hot water cylinder or gas appliance to and including taps. 10.4 The cold water supply tank, its feed and outlets. 10.5 Any defect or inadequacy attributable to the original design of the gas central heating system appliances. 10.6 The fabric of the building or any pipework buried in solid floors. 10.7 Any defect caused through malicious of wilful action, negligence. misuse, or third party interference. 10.8 Consequential damage or loss arising as a result of a defect occurring in the central heating appliance, system or the gas appliance unless such a defect, damage or loss is attributable to the negligence of EmanuelSpence. 10.9 Any defect or damage occurring from failure of the public electricity, gas or water supply. 10.10 Descaling and any work arising from hard water scale deposits or from damage caused by aggressive water. 10.l The maximum boiler depth covered to be 44Kw/hr and appliance must be less than 10 years old. 10.12 The cover includes one heating boiler and or one water heater. 10.13 Faults to flues, cowls and chimneys are excluded from cover. 10.4 Heat exchangers in combination boilers are excluded from cover. 10.15 The cover does not include the cost of repairs or upgrading to make the system comply with current regulations or ventilation requirements. 10.17 Temporary heating is not included in this contract but is available at extra cost.
10.18 Gas leaks are not covered by this service contract - unless inside the appliance. 11. RIGHT TO CANCEL You have the right to cancel this policy within 28 days if no visit or claim has been made. GAS SERVICE COVER 1.1 You should call Transco initially on 0800 1lI 999 for them to isolate your gas supply, then call Emanuel Spence Ltd. 1.2 Transco will be responsible for repairing any external gas leaks, Transco will spend 30 minutes repairing any internal leak 1.3 The gas service cover will cover any repair to the internal gas pipe-work and fittings. 1.4 Work will only be carried out from 08.00 to 17.00 hrs Mon - Fri. 1.5 Cover is limited to £500 per annum. 2. EXCLUSIONS 2.1 We do not cover pipe-work under concrete floors. 2.2: We do not cover any lead pipe-work. 2.3 We do not cover any works required to bring installations up to the current gas safety standards LANDLORDS COVER C.P 12 is provided when the cover or invoice has been paid 1. EXCLUSIONS 1.1 We do not cover damage or neglect from Tenant's 1.2 We do not cover appliances which have been dismantled or an attempted repair made by the Tenant 1.3 We do not cover houses of multiple gas appliances
